CLICNSCORES – TERMS OF USE

Please read Terms and conditions carefully before downloading the content and services. Your using the portal / downloading the content shall be deemed as your explicit consent for the services at this portal. You accept these terms of use and that agree to abide by them.

ClicNScores is the name of a sports news portal through WAP (Wireless Application Protocol) services to the compatible mobile and handheld devices (the « service »). Only after proper registration and payment, the access to the said sports news portal and the compatible mobile phones and other compatible devices shall be granted. We collect some or all of the following information about your device: device type (e.g. smartphone, tablet, etc.), operating system (e.g. iOS, Android, Windows, Blackberry), network provider, Internet (IP) address, which mobile browser you use (e.g. Safari, Internet Explorer etc.), the carrier user ID (a number uniquely allocated to you by your network provider), the geo-location of your device (using GPS or other geo-location data) and the unique device identifier of your mobile device (a number uniquely allocated to your device by your device manufacturer). We use your usage information to analyse our WAP traffic, to figure out how often customers use parts of the site, to improve the site and generally to make it appealing to as many users as possible. We may also share your information among our affiliates so that we can better provide better services that are relevant to you. We may also use the information to help us develop our offers and the layout of our portal to ensure that our services are as useful and enjoyable as possible.

From time to time, we may need to disclose your information to third parties such as to law enforcement authorities or our legal advisers, where it is necessary to comply with the law or regulation; enforce or apply our user terms and conditions; to protect our rights, or to preserve the safety of our users. This may include exchanging information with other companies and organizations for fraud protection. We retain information for only as long as is necessary to fulfil the purposes outlined in this T&C, unless otherwise required by law.

The contents subscribed are provided “as is” without any warranty of any kind as to accuracy, completeness, merchantability, satisfactory quality, non –infringement of Intellectual Property or fitness for a particular purpose. The subscription fee /charges are always mentioned at the point of purchase i.e. commencement of subscription period or date of downloading the content/service. The charges shall be billed according to the billing method agreed between the subscriber and the service telecommunication provider. Payment takes place easily over your monthly phone bill or pre-pay credit. There is only a weekly subscription model. The subscription fee shall become due every week till the time the subscriber is subscribing to this service irrespective of whether or not the content is actually downloaded during any particular subscription period.

The use of Service is done at subscribers own discretion risk and understanding and subscriber will be solely responsible for any damage or loss of data that results from use of such content. The Service is not fault free and it may be impaired by geographic, atmospheric or other conditions or circumstances beyond the control including, without limitation, congestion, network coverage/error, dropped connections, the performance of subscriber’s device and the maintenance of secure network connections.

If your device does not support relevant technology including but not limited to encryption you may not be able to use certain services or access certain information on the Portal.
It is a condition of us allowing you access to the information on the Portal that you accept we will not be liable for any action you take relying on the information on the Portal. We will not be liable if your use of materials or information from the Portal results in the need for servicing, repair or correction of equipment or data, you assume any costs relating to the above.

Information provided by us does not constitute legal or professional advice and should not be relied upon without taking independent advice. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our Portal or by anyone who may be informed of its contents.
You are aware that your mobile number is being captured through our WAP promotional page (where your IP is being tracked), you give us unconditional and express authorization to communicate/make calls/ send SMS to your mobile number in future.

If you choose or are issued with a user identification code, password or any other piece of information as part of any registration or security procedures, you must treat such information as confidential and are fully responsible for all activities that occur under your password and account. You agree to immediately notify us of any unauthorised use or breach of security. We cannot be held liable for any loss or damage arising from your failure to comply with this term. We reserve the right to disable any user identification code or password.

You agree to use the Portal only in a lawful manner and further agree not to cause, nor knowingly allow others to cause, any nuisance, annoyance, or inconvenience by any means, including without limitation by a denial of service attack, knowingly introducing viruses, trojans, worms, logic bombs or other material with is malicious or technologically harmful, harassment, impersonation of another person or entity. You also agree not to use the Portal to transmit or post any material which is fraudulent, unsolicited or unauthorised advertising or promotional material, hateful, sexually, racially or ethnically or otherwise objectionable, defamatory, offensive or obscene or menacing character or which may in our judgement cause nuisance, annoyance, inconvenience to us, or any other person or which is illegal. You will not use the Portal such that you would cause the whole or part of the Portal (including the server on which it is stored or any server, computer or database attached to it) to be interrupted, damaged, rendered less efficient or impaired in any way. In such circumstances your right to use the Portal will cease immediately.

We do not accept responsibility for any defects that may exist or for any costs, loss of profits, loss of data or consequential losses arising from your use of, or inability to use or access or a failure, suspension or withdrawal of all or part of the service at any time. We exclude all liability whether in contract, tort (including liability for negligence) or otherwise for the accuracy, suitability, quality or completeness of any information and the value and integrity of goods and services offered. We may suspend or vary the whole or any part of the service offered on the Portal for any reason, at any time at our sole discretion without liability to you.

We may amend this T&C at any time. The amended T&C becoming effective immediately upon posting of the Amended T&C on the Portal. By continuing to use the Portal you will be deemed to accept such amendment. Please check our T&C regularly to ensure you have read the latest version. If any part of these terms is found to be illegal or unenforceable, this will not affect the validity or enforceability of the remainder of these terms.

The subscription of services shall be governed by the Laws of India and the Courts of law at Delhi / New Delhi shall have exclusive jurisdiction over any disputes arising out of or due to subscription of services without regard to conflict of laws and principles thereof.
